New Delhi | The Supreme Court has observed that divorces granted by Christian church marriage tribunals are invalid.
The apex court ruled that marriage after getting divorce in this manner is punishable.
Considering a writ filed by Karnataka Catholic Association former President Clarence Pius Tuesday seeking legal validity for divorce granted under Canon law, a Division Bench consisting Chief Justice TS Thakur and Justice DY Chandrchud made it clear that only divorce granted by civil courts are legally valid.
The petitioner asked why the Christian Canon Law is not getting equal legal protection as the Muthalaq special law of the Muslim community.
